This MAILBOX Service Agreement (“Agreement”) is made and entered into by the customer identified above (“CUSTOMER”) for the use of and services related to a virtual mailbox (the “MAILBOX”) at CrackBox, Inc, doing business as Super Postal Center, hereinafter referred to as “Mail Service” under the terms set forth herein and governed by the laws of the State of Florida.
Each individual or entity must complete a separate USPS Form 1583 to be authorized to receive mail or packages at the Mailbox.
Applicant agrees that Applicant will not use the Mail Service for any unlawful, illegitimate, or fraudulent purpose, or for any purpose prohibited by U.S. Postal Regulations. Applicant further agrees that any use of the Mailbox shall be in conformity with all applicable federal, state, and local laws.
Mail Service will use reasonable efforts to keep this Agreement and Form 1583 confidential, except that this Agreement and Form 1583, including Applicants name, address, and e-mail address, may be disclosed to employees, or successors of this Mail Service, and upon written request of any law enforcement or other governmental agency, or when legally mandated. Upon request, Applicant agrees to complete all necessary documents, including Form 1583 and any required acknowledgement form relating to service of process. Applicant further agrees to sign a revised version of this Agreement and Form 1583 whenever any information required on this Agreement or Form 1583 changes.
Applicant acknowledges that mail will be kept in a secure container, not a locked mailbox. Applicant will not receive a key for a virtual mailbox, and mail will only be stored up to 30 days unless instructed otherwise by Applicant. Mail Service shall not surrender any mail to anyone other than the Applicant without express written consent by the Applicant.
Applicant agrees to provide the Mail Service with a current Credit Card for rental or other fees. Mail Service will charge said credit card at the end of each month for services rendered, based on the current Virtual Mailbox fees.
Applicant agrees that service is only for standard mail, and not for packages. Applicant agrees that delivery of any packages will incur a charge of $5/day for every day said packages are stored at Mail Service, beginning with the day received. Applicant understands that under no conditions will Mail Service accept any freight shipments.
Applicant agrees that upon expiration, cancellation, or termination of this Agreement, Applicant will not file a Change of Address (COA) order with the USPS. Applicant authorizes the Mail Service to accept and destroy any “unsolicited mail” (e.g., mail addressed to “occupant”, “current resident”, or similar designation; or coupons, advertising, or other promotional material) and any mail addressed to Applicant that is delivered to the Mail Service via USPS for six (6) months; and may refuse any package addressed to the Applicant delivered by any party other than the USPS, such as commercial carrier service. However, at Applicant’s election, the Mail Service will:
Re-mail/forward Applicants mail (except for Unsolicited Mail) for six (6) months upon Applicants payment in advance for postage, packaging material, and forwarding fees. Applicant must pay a monthly forwarding fee of $10.00 for month one, and $50.00 for months two through six in advance for the time period that mail is to be re-mailed. It is Applicants responsibility to make arrangements with the Mail Service to identify any mail forwarding needs prior to the expiration, cancellation, or termination of this Agreement; or
Store the mail or USPS packages (except for Unsolicited Mail) for up to six (6) months upon Applicants payment in advance of a storage fee of $10.00 per month for the time period in which the Center holds the mail or packages, plus a service fee of $5.00 for each time Applicant visits the Mail Service to pick up items. It is Applicants responsibility to make arrangements with the Mail Service to identify any mail storage needs prior to the expiration, cancellation, or termination of this Agreement.
Six (6) months after the expiration, cancellation, or termination of this Agreement, the Mail Service may:
Refuse any mail or packages addressed to the Applicant and delivered to the Mail Service;
Destroy any of the Applicant’s mail or packages remaining at the Mail Service at such time.
The term of this Agreement shall be month to month. and shall renew automatically at the end of each month. Renewal of this Agreement for additional terms shall be at the Mail Service’s sole discretion. Applicant agrees to notify Mail Service in advance of termination of this agreement.
For the purpose of re-mailing/forwarding any items internationally, Applicant authorizes Mail Service to complete and file all necessary international shipping documents to the best of the Mail Service’s ability. Applicant further agrees to provide the Mail Service with true, accurate, and complete information regarding the contents of any mail or packages to be re-mailed by the Mail Service, whether during the term of the Agreement or after termination or cancellation. Applicant agrees not to hold Mail Service liable for any inaccurate information, or for failure to completely and/or accurately complete any necessary international shipping documents.
Applicant agrees that the Mail Service may terminate or cancel this Agreement for good cause at any time by providing Customer with written notice. Good cause shall include, but is not limited to: 1) Applicant abandons their mail and does not provide current address info for forwarding mail; 2) Applicant uses the Mail Service for unlawful, illegitimate, or fraudulent purposes; 3) Applicant fails to pay monies owed the Mail Service when due; 4) Applicant receives an unreasonable volume of mail or packages; 5) Applicant engages in offensive, abusive, or disruptive behavior toward other customers or the Mail Service or the Mail Services employees; and 6) Applicant violates any provision of this Agreement. Applicant acknowledges that, for the purpose of determining good cause for termination of this Agreement as provided herein, the actions of any person authorized by Applicant to use the Mail Service will be attributed to Applicant. In addition to termination or cancellation, Applicant acknowledges that Mail Service may refuse any renewal or extension of the Applicant’s service at the Mail Service, and regardless of good cause.
Any written notice to Applicant required or permitted under this Agreement shall be deemed delivered twenty-four (24) hours after placement of such notice in Applicant’s Mailbox or at the time personally delivered to Applicant.
As Applicant’s authorized agent for receipt of mail, the Mail Service will accept all mail, including registered, insured, and certified items, and, if authorized on Form 1583, restricted mail. Unless prior arrangements have been made, the Mail Service shall only be obligated to accept mail or packages delivered by commercial carrier services, which require a signature from the Mail Service as a condition of delivery. Applicant must accept and sign for all mail and packages upon the request of the Mail Service (at the customers request, forwarding via email scan or mail forwarding any items to the customer constitutes the customers acceptance of receiving that item). In the event Applicant refuses to accept any mail or package, the Mail Service may return the mail or package to the sender and the Applicant will be responsible for any postage or other fees associated with such return. COD items will be accepted ONLY if prior arrangements have been made and payment in advance is provided to the Mail Service. Applicant agrees to accept any and all Service of Process addressed to Applicant or any other legal entity using Mail Service. Applicant agrees that Mail Service can withhold any and all other mail for Applicant until Applicant accepts and signs for receipt of any Service of Process. Under no circumstances will Mail Service scan/email the back side of any credit cards received. Applicant further agrees to pay any and all legal fees, expenses, and time incurred by Mail Service related to Process of Service, including a subpoena to testify at a trial or deposition.
Applicant agrees to protect, indemnify, defend, and hold harmless the Mail Service, officers, directors, agents and employees from and against any and all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, costs, and causes of action of every type and character arising out of or in connection with the use of the Mail Service, including without limitation, any demands, claims, and causes of action for personal injury or property damage arising from such use or possession, from failure of the USPS or any commercial carrier service to deliver on time or otherwise deliver any items (mail, packages, etc.), from damage to or loss of any package or mail, or to the Applicants mail contents by any cause whatsoever, from penalties, fines, or other liabilities that arise out of, or in connection with, the Mail Service’s actions or status as Applicants agent with respect to export transactions, or the Mail Services completion and filing of any Shipper’s Export Declaration on behalf of Applicant, and from any violation by Applicant of applicable federal, state, or local laws, or the laws of any foreign jurisdiction.
Applicant herein agrees that the total amount of liability of the Mail Service, if any, for any and all claims arising out of or related to this agreement or performance hereunder shall not exceed $100.00 regardless of the nature of the claim. Applicant further agrees that payment of any such claim will result in the termination of all services between the Mail Service and Applicant.
Applicant must use the exact mailing address for the Mail Service without modification as set forth in Section three (3) of form 1583. The USPS will return mail without a proper address to the sender endorsed “Undeliverable as Addressed.”

Failure to Pay Clause: Anytime Mailbox runs monthly charges around the 5th of each month. If Applicants Credit Card should be declined for any reason, Mail Service shall immediately "deactivate" Applicants account/service, which will block Applicant from access to Mail Service. Applicant has one week to update payment info, which needs to be done by contacting the Mail Service directly at 561-750-6750, or by emailing Superpostalcenter@gmail.com. One week after deactivating, Mail Service will "Unassign"/Terminate service if payment for monies due still do not clear through.

Upon signing this Agreement, Applicant shall provide two (2) forms of valid identification, one of which shall include a photograph. This Agreement may not be amended or modified, except in writing signed by both parties.

Customer acknowledges that SPC will scan mail and process action items within a reasonable time, and that requests for rush/expedited services will entail additional charges when available.
